Out of every rain a little sunshine must come. It appears I can take 90-03 and have certificcation now. And then come back at a later date and try to improve it to include 04-05. I do believe that is what I'll do. The ONLY 04-05 Coldside that I know of is sitting in my garage.
I'd like some feedback from you people, especially Californians.

90-03 is a whole lot of Miata customers in CARB states. Sell em your kits and have the profits from that pay for the next stab at CARB

Elphaba makes perfect business sense as many of the 04-05 owners are still paying for their cars. In good time you can (and will, I suspect) get the nod for them as well.

It is smarter to go with the '90-'03 and ditch the last two years.
But since this time the car is with a different software map (compared to the last time when it passed the other tests) they will probably ask you to redo the rest of the tests or use the old map.

Well my vote would be to take the 90-03. First thing in "07" I want one of the kits so you know where I stand.
Would you 04-05 drivers want to keep us from our fun?

Well done Tom. This is no small feat whatever you decide. You probably already know this but you are quite the tenacious man.
I own a 99 so, of course, I am a bit biased. That I might actually live without fear of the highway patrol wanting to look under my hood is a big thing for me. There is little time in my life these days to take my car apart and less $ to spend on fines. I cannot guess how many potential buyers get left out, and or for how long they get left out.
If you go with the current EO and seek the other later what is lost from your current status in the certification process? Another piece of the puzzle is what is in the way of getting it all? Is it all or none? I am a list guy. I weigh things best when I have listed all the pros and cons next to eachother for each option.
PS
When there is certification I am in for whatever bits I need to nestle under that wing. I am secretly waiting to see the new PC pro.

The deed is done. I have alerted CARB that I will go ahead with the 03 and older and skip the 04-05 for the time being. We will re-evaluate that when it becomes relavant.
Anybody want an awesome 2005 Metallic Green Miata with 22,000 miles and a perfect Coldside? :) Not California legal. But an awesome ride in the other 49 states. ;)
ps. Brand new set of Toyo T1Rs (will be installed today) and a brand new Koyo radiator waiting for CARB to tell me they don't need the car anymore so it can be installed.

It would be a great Christmas present to myself...so when can we realistically expect to install turn key and not get pulled over by the CHP and explain and make excuses...Also autocross season around here starts in March...when when when...

I should have the number no later than January. I think it is a matter of days/weeks at most. Order now. Install o9ver Christmas and run legal in January. He told me 30 days worst case.

I was about to float the idea that we, as a community, take up a collection so that Tom would give it a third try.
But to heck with the others now, I'm a 99.

Are you going to use the old software map - the one which you passed the test the last iteration? Or the new software map (which you mentioned should be much better) will have to go through testing (sans the US06) to become '90-'03 approved too?

I am awaiting their decision which to use. I would prefer to use the latest map as it is the enviornmentally cleanest and runs great too. They have the US06 results to back it up and that includes the FTP so I doubt they will make me run the FTP again. They were meeting on that subject this afternoon/evening so I should have an answer later tonight. Tim is an dedicated public servant at CARB and works to 6:00 every night. So it will be awhile. They are also going to decide if I need to take it over there for them to run confirmation tests. If the answer to that is no, I could have my EO in days. If it is yes, it could take a couple weeks for them to take the car and run the tests.

Here's how I see it:
Wouldn't most of the 04-05 owners still be under their original manufacturer's warranty? If they are they won't want to mess that up by adding something that could void their warranty... although once the warranty expires they'll start to call. It will take another year before most of them will be out of warranty.
Tom and I have talked about his test results and what it will take for the 05 car to pass... the car can pass the test but it's more time and money for what is today a small part of the market. In another year that may change.
So I say take the certification you can get now becasue it will cover 95% of your market. See how many requests you get for 04+ kits in the coming year and decide when (or if) to re-test for only those years.
Good job Tom. I know this has been frustrating at times. If I can speak on behalf of your current and future California customers your efforts are greatly appreciated!

Here's the latest. They are going to re-issue the test letter deleting the US06/SC03 requirement. Then I have to go back for a re-do of the test with the new cleaner fuel curve. This time passing is a done deal as we passed those tests the first time and it is much cleaner now.
Worst case we should have the EO# By Christmas.

Heck! Becoming smog legal is the best Christmas present I could ask for. I originally sold my home made M62 and bought the Coldside because it was promised that CARB would be pursued. Now it is pretty much here. After all the twists and turns I can't believe it is actually happening. Last month when it failed the first time I thought "This is it, it isn't going to happen and I should just give up on this car ever being legal and look into something that is light quick and legal from the dealer". It was a depressing thought because this is the perfect car for me. Now I am like a kid with a new toy. Life is funny that way.
